The Constitutional Court has dismissed, with costs, the uMkhonto we Sizwe (MK) political party.
This comes after , the current leader of the official opposition, the MK Party, in the National Assembly, John Hlophe’s bid to appeal the interim interdict that has barred him from serving on the Judicial Service Commission (JSC).
Meanwhile , the court dismissed the application for leave to appeal as no case has been made out for a direct appeal.
Hlophe was barred from the Western Cape High Court sitting in the JSC in September last year pending the main bid to challenge his suitability to serve on the body which appoints and disciplines judicial officers.
The court has since heard the main arguments on the suitability of Hlophe, who has been removed from judicial office, to sit on this body and judgment remains reserved.
